Point Money Card Asia Corp. Service Terms of Use

Effective Date: March 1, 2025

Article 1. General Provisions

1-1. These Terms and Conditions set forth the terms of use for the prepaid card-related services (hereinafter referred to as the "Services") provided by Point Money Card Asia Corp. (hereinafter referred to as the "Company").

1-2. Members shall comply with these Terms and Conditions when using the Services.

1-3. These Terms and Conditions shall take effect when a member registers to use the Services and agrees to these Terms. The Company may revise these Terms as necessary, and such revised Terms shall take effect at the time the Company notifies members in an appropriate manner and the member uses the Services.

1-4. PMC Cards issued through the Services are provided under separate terms of use specified by the Company, and as a general rule, members are prohibited from transferring, lending, pledging, or otherwise assigning the cards to third parties. However, exceptions may be made if expressly approved by the Company (e.g., issuance of family cards or corporate cards).

Article 2 Definitions

The definitions of terms used in these Terms and Conditions are as follows:

2-1. “Company” means Point Money Card Asia Corp., located in the Republic of the Philippines, which provides the Services.

2-2. “Member” means an individual or corporation who has registered to use the Services and agreed to these Terms.

2-3. “Account” means an electronic account opened by the Company for Members, used to manage the balance of funds and for charging, transfers, and payments.

2-4. “Transaction” means all acts conducted by Members through the Services, including card charging, payments, transfers, and related activities.

2-5. “Business Partner” means any commercial entity, corporation, or business entity that conducts transactions using the Services.

2-6. 「“Jurisdiction” means the Republic of the Philippines, where the Company is established.

2-7. “PMC Card” or “Card” means a prepaid virtual or physical card issued by King Luster Limited (Hong Kong) and provided to Members through the Company.

2-8. “Card Issuer” means King Luster Limited, a Hong Kong corporation that issues the PMC Card.

2-9. “PIN” means a personal identification number issued or authorized by the Company or the Card Issuer for use with the Card.

Article 3 Membership

3-1. Applicants must be at least 18 years old or have reached the age of majority in their country of residence.

3-2. Applicants agree to provide required information and documents specified by the Company and undergo verification of identity, address, and credit checks.

3-3. Members must provide valid address, phone number, email address, and promptly update these if changed.

Article 4 Provision of Services

4-1. The Company shall provide Members with the following services:

  • ・Opening and managing virtual accounts
  • ・Fund transfers between virtual accounts
  • ・Issuance of virtual and physical cards
  • ・Card funding (charging)
  • ・Balance management and transaction history services
  • ・Card management platform services

4-2. PMC Cards issued under the Services are issued by King Luster Limited (Hong Kong) and operated by the Company. PMC Cards include digital (online-only) and plastic (physical) cards.

4-3. The Company and Card Issuer may change, add, suspend, or terminate all or part of the Services without prior notice for technical, operational, or other reasonable reasons.

Article 5 Registration

5-1. Use of the Services requires applicants to be at least 18 years old or the legal age of majority in their country.

5-2. Applicants must apply through the Company’s designated process and agree to identity, address, and credit verification.

5-3. Submission of documents specified by the Company is required.

5-4. Members must provide valid contact information and update it promptly if changed.

5-5. The Company reserves the right to approve or deny registration and is not obligated to disclose reasons for denial.

Article 6 Account Management

6-1. Members must strictly manage their login credentials (user ID, password, PIN, etc.) and not allow third-party use.

6-2. Members must not lend, transfer, sell, or provide their login information as collateral to third parties.

6-3. The Company bears no responsibility for damages caused by unauthorized use unless attributable to the Company.

6-4. Members must immediately notify the Company if login information is leaked, lost, stolen, or misused.

6-5. Members must promptly notify the Company of any changes to account registration information.

Article 7 Fees and Charges

7-1. Transactions may incur fees, which will be posted on the Company’s website.

7-2. Dormant accounts may be subject to maintenance fees.

7-3. The Company may change fees and rates at any time, with notice provided on the website.

7-4. The Company may waive or reduce fees at its discretion.

7-5. Fees are charged and settled in USD and automatically deducted from account balances. Foreign currency transactions are subject to conversion fees.

Article 8 Account Management

8-1. Accounts are for electronic money only, not for storing cash or securities.

8-2. Members may charge funds per the Company’s rules.

8-3. The Company may set maximum and minimum charge amounts.

8-4. Account Usage

  • a. When an account application is submitted and approved by the Company, both individual and corporate accounts may be opened.
  • b. Members acknowledge that their accounts are electronic money accounts and do not handle cash or securities of any kind. The use of PMC Cards for the purpose of cashing out electronic money or cryptocurrency purchases is strictly prohibited.
  • c. At the time an account is opened, Members are deemed to have agreed to the Terms of Use, Fee Schedule, and Privacy Policy effective at that time.
  • d. Members are granted the eligibility to apply for linked PMC Cards. However, even if the card issuer or operating company refuses card issuance, the Company bears no responsibility.
  • e. To deposit electronic money into their own account, Members must comply with the procedures prescribed by their country of residence. The methods and procedures for deposits will be described and published on the Company’s website.
  • f. When a Member deposits funds into their own account, they agree that applicable fees for each deposit method will be deducted, and only the net balance will be credited to their account.
  • g. The Company may establish upper and lower limits for each deposit method. These limits will be published on the Company’s website.
  • h. If a Member uses a credit card to purchase electronic money for deposit into their account, and the credit card issuer later initiates a chargeback, the Member agrees that the equivalent amount of electronic money will be deducted from their account. If such deduction results in a negative balance, the Member must immediately cover the shortfall.

Article 9 Transactions

9-1. Members may use prepaid cards for payments within account balances.

9-2. Transactions exceeding balances will be declined.

9-3. Completed transactions cannot be cancelled or refunded.

9-4. Even if an error occurs during card payment, transaction fees associated with the payment process may still be incurred due to the specifications of the Company’s system and the card issuer. These fees are imposed by the card issuer and may not be refunded even in the case of an erroneous transaction. However, if the error arises due to reasons attributable to the Company, the Company may, at its sole discretion and within a reasonable scope, take appropriate measures.

Article 10 Cards

10-1. The name of the card issued under this service shall be “PMC Card.” The PMC Card is a prepaid card issued by King Luster Limited, a Hong Kong corporation (hereinafter referred to as the “Card Issuer”), and managed and operated by the Company. A “Card Member” refers to an individual or legal entity who holds a PMC Card and agrees to these Terms. The PMC Card includes both virtual cards and plastic (physical) cards.

10-2. The PMC Card becomes valid once the member agrees to these Terms, completes the issuance procedures prescribed by the Company, and passes the Company’s screening criteria. The applicant is obligated to provide the information and documents requested by the Company and agrees that the Company may entrust third parties to obtain personal information for identity verification, address verification, and credit checks. The applicant shall not raise objections to the decision of the Company or the Card Issuer regarding the approval or denial of card issuance.

10-3. Upon completion of the prescribed application process and approval by the Company, the applicant shall become a Card Member and may begin using the card. By using the card, the Card Member is deemed to have agreed to these Terms, the Privacy Policy, and the Fee Schedule in effect at that time. In principle, one account shall be permitted per name. The Card Member agrees that the purpose of card issuance shall not be for cashing electronic money or cryptocurrency, money laundering, or any other unlawful activity.

10-4. Upon completion of the prescribed application process and approval by the Company, the applicant shall become a Card Member and may begin using the card. By using the card, the Card Member is deemed to have agreed to these Terms, the Privacy Policy, and the Fee Schedule in effect at that time. In principle, one account shall be permitted per name. The Card Member agrees that the purpose of card issuance shall not be for cashing electronic money or cryptocurrency, money laundering, or any other unlawful activity.

10-5. If the card expires, becomes damaged, lost, or stolen, the Company may reissue a card with a new card number upon the member’s request. Once the reissuance process begins, the old card shall become invalid and the associated card account shall be frozen.

10-6. The Card Member acknowledges that reissuance may take considerable time, and in cases of loss or theft, the balance will only be transferred to the new card after the Company or the Card Issuer completes an investigation into unauthorized use. The Company and the Card Issuer reserve the right to suspend or deny reissuance requests from members.

10-7. The Company shall bear no responsibility for any damages incurred by the member as a result of card reissuance, card number changes, or measures such as suspension due to violations of unauthorized use.

Article 11 Termination

11-1. A Card Member may voluntarily terminate the card at any time by contacting the Company’s customer service and completing the procedures prescribed by the Company.

11-2. In the event of voluntary termination, the Card Member must physically destroy the card and report the destruction to the Company upon request.

11-3. The Card Member agrees that, upon voluntary termination, the card account will be frozen, any remaining balance will be applied to transactions conducted prior to termination, and no refunds will be made by the Company. Therefore, prior to applying for voluntary termination, the Member must check their balance and settle it as necessary under their own responsibility.

11-4. The Company may forcibly terminate a card and freeze the card account without prior notice if it determines that any of the following apply:

  • a. It becomes evident that the Card Member has engaged in unauthorized use of the card.
  • b. The Card Member has violated these Terms.
  • c. The personal information provided at the time of application or use is found to be inaccurate or incomplete.
  • d. The Card Member has used the card for money laundering or other criminal activities in violation of the laws of Hong Kong or the country of use.
  • e. The Card Member defames the Company or the Card Issuer and significantly interferes with business operations (including acts on the Internet, bulletin boards, etc.).
  • f. The card or card account is subject to seizure or other legal measures under the laws of Hong Kong, the Member’s country of residence, or the country of use.
  • g. The Company determines that maintaining the card is legally or socially harmful.
  • h. The Card Member engages in fraudulent cashing of electronic money or cryptocurrency using the PMC Card.

11-5. In the event of forced termination, the card shall immediately become invalid, and the card account shall be closed.

11-6. If a Member does not log into their account for two consecutive years, the Company may forcibly terminate the account and card. In this case, even if there is a balance in the account, the Member shall be deemed to have forfeited it.

11-7. Members whose accounts have been forcibly terminated due to unauthorized use or other serious reasons shall not be permitted to reapply for account registration.

Article 12 Personal Information

12-1. The Company shall obtain the personal information of Card Members and applicants within the scope necessary for business execution, and manage and store such information in an appropriate and secure manner.

12-2. The Company will not disclose acquired personal information to third parties except in the following cases:

  • a. When disclosure is required under applicable laws and regulations of the Philippines
  • b. When disclosure is required by a lawful order from a court, regulatory authority, or other public institution
  • c. When it is necessary to entrust part of the business to a third party for operational purposes (provided that the Company enters into a confidentiality agreement with the said third party)
  • d. When the cardholder consents, or when the Company reasonably determines that it is necessary to protect the interests of the cardholder
  • e. When the cardholder uses the card for money laundering or other criminal acts in violation of the laws of Hong Kong or the country of use

12-3. A Card Member may request disclosure of their personal information held by the Company; however, any costs incurred in such disclosure shall be borne by the Member.

12-4. Card Members agree that necessary information may be registered with, or obtained from, credit information agencies with which the Company or the Card Issuer is affiliated.

12-5. Card Members agree that the Company may share personal information with government agencies, central banks, and related public institutions in the Republic of the Philippines and overseas for the purposes of anti-money laundering (AML) and counter-terrorism financing (CFT).

12-6. If fraudulent use is identified, the Company may provide information to international fraud prevention organizations or other appropriate entities.

Article 13 Governing Law and Jurisdiction

13-1. These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

13-2. These Terms are prepared in English. In the event of any discrepancy between the English version and any translation, the English version shall prevail.

13-3. Any disputes arising in connection with these Terms, card issuance, or card usage shall be subject to the exclusive jurisdiction of the courts located in the Republic of the Philippines as the court of first instance.

13-4. Card Members waive the right to participate in any class action lawsuits against the Company or the Card Issuer.

13-5. Even if any provision of these Terms is deemed invalid or unenforceable by law or a court decision, the validity of the remaining provisions shall not be affected.
